Who can file a land case in American Samoa?

Your ability to file a court case relating to land in American Samoa depends on the type of land at issue.

Communal Land
In order to bring an action relating to communal land in American Samoa, it must be brought in the name of the sa’o or senior matai of the communal family. This means that the sa’o must be listed as the Plaintiff.

The sa’o is the registered senior matai of the family holding an ali’i title, or High Chief title who acts as the custodian of the family land.

If the sa’o title is vacant, an action can be brought by two blood member male lesser matais of the family. If two blood member male matais are not available, then two blood members of the family may bring an action. Anyone bringing an action must be over 18 years old.

Individually-owned or Freehold Land
Only the registered owners of individually-owned land and freehold land can bring an action relating to the land in the High Court of American Samoa.
